This privacy statement at www.devantis.net applies to the use of our website, contact and order forms, and our newsletter, as well as the management of personal data by our company concerning clients and users of the website over 16 years of age.

Depending on the processing of personal data, it is possible that applicable Swiss law (Federal Act of 19 June 1992 on Data Protection (FADP), RS 235.1) may also be supplemented by European data protection law (Regulation (EU) 2016/679 (General Data Protection Regulation)), particularly concerning the monitoring of the behavior of persons residing in the EU (Art. 3, para. 2, point b) GDPR) and concerning the delivery of products in the Principality of Liechtenstein (Art. 3, para. 2, point a) GDPR), once the GDPR has been adopted there. Processing of personal data concerning website users

a) When visiting the website

When you contact us by email, we store the contact details you voluntarily provide, such as your name and email address, solely for the purpose of responding to your request or processing it. Please note that data exchange via email is not secure. In particular, for confidential information or sensitive personal data, we recommend opting for an encrypted mode of transmission. Therefore, we kindly ask you to let us know if you wish to communicate with us in an encrypted manner.

We process this data based on our overriding legitimate interest or to allow you to use the website (Art. 13, para. 1 FADP and Art. 6, para. 1, sentence 1, point b) GDPR).

c) When using one of the contact forms

For any questions or to order a catalog, we offer you the possibility to contact us via a form available on the website. In doing so, providing your contact details, including a valid email address and, if applicable, your customer number, is necessary for us to know who is making the request and to be able to respond.

You can voluntarily provide us with your company name, address, or phone number.

The processing of data for the purpose of contacting us is carried out in order to execute the contract or take pre-contractual measures, as per Art. 13, para. 1 FADP or Art. 6, para. 1, sentence 1, point a) GDPR.

d) When subscribing to a newsletter

You have the option to sign up for a personalized newsletter on our website. For registration, we collect your salutation, first name, last name, email address, date of birth, and your consent to receive the newsletter.

Subscription to the newsletter only becomes final after a double confirmation: once you have registered on our website, you will receive an email in which you can click to confirm that you want to receive the newsletter. If you do not wish to, simply ignore the confirmation email. If you wish to stop receiving the newsletter later, you can either click the unsubscribe link sent by email with each newsletter, or contact us at the email address info@devantis.net or by postal mail.

Your personal data is transferred to the provider Emarsys for sending the newsletter. They operate the email marketing system on our behalf. The newsletter can be personalized based on your customer type, click behavior, and purchase data. We process this data for direct marketing purposes aimed at newsletter subscribers.

We process the data based on your consent as per Art. 13, para. 1 FADP or Art. 6, para. 1, point a) GDPR.

Processing of customer personal data

a) Opening an online customer account or placing an order as a guest

You have the option to create a password-protected online customer account with us for order entry and processing. This also covers the creation of offers, orders, repairs, deliveries, and assembly. The customer account helps you manage your orders. You can also manage past orders, current data, and newsletter preferences.

For this purpose, we collect your salutation, name, first name, if applicable, your company name, email address, postal address, phone number, and any consent to receive our newsletter.

When placing an order as a guest, we collect the same data, but in this case, you do not create a customer account.

Data processing to make the ordering process simpler, more efficient, and user-friendly is carried out in accordance with Art. 13, para. 2, let. a FADP and Art. 6, para. 1, point b) GDPR for the execution of the contract or the performance of pre-contractual measures at your request.

b) When entering an order using an order form, by phone, fax, email, or when ordering online and ShopPLUS from the central warehouse or a supplier's warehouse

In order to fulfill your order, we process your name, first name, phone number, email address, and order information. This also includes the creation of offers, orders, repairs, returns, deliveries, and assembly, customer service processing as well as for collection or enforcement through legal means. If you contact us by phone or fax to place an order, we collect the necessary contact and purchase data to fulfill the order.

We transfer this data to third parties who process it for us (e.g., for credit checks, updating our credit risk, verification in the Swiss commercial register, or managing pending customer requests), to distributors and logistics partners to deliver our products to you, as well as to authorities and courts.

Data processing is carried out at your request and is necessary, in accordance with Art. 13, para. 1, let. a FADP and Art. 6, para. 1, sentence 1, point b) GDPR, for the execution of the contract and the performance of pre-contractual measures.

c) When participating in a customer loyalty program

If you complete the 'card request for participation in the customer loyalty program' form from DEVANTIS SA (bonus program, marketing campaigns), we collect the following data about you: business or private customer, company name, salutation, name, first name, date of birth, and contact details. Once you have completed the form, it is sent to OWIBA SA.

If you use the Office PLUS card when making a purchase, we collect your purchase data and analyze it to better tailor our sales offers to our customers.

Data processing for the aforementioned purposes is carried out based on your consent under Art. 6, para. 1, sentence 1, point a) GDPR.

d) When purchasing on account

If you wish to place an order with us on account, we reserve the right to carry out a credit check through a third party. We process the data received regarding your creditworthiness to ensure the proper execution of the contract.

e) When paying by credit or debit card

If you wish to make a payment using a credit or debit card, we collect the card data, your name, and first name, as well as the purchase amount, and transmit them to the payment service provider to execute the payment order. Subsequently, we only store the transaction number and not the complete card data.

Data processing is necessary for the execution of the contract in accordance with Art. 13, para. 1, let. a and c FADP and Art. 6, para. 1, sentence 1, point b) GDPR and for pre-contractual measures.

f) For advertising purposes

We also send our printed advertising (catalog, promotions) to targeted customer groups. These communications may also come from other companies within the MTH group. You can unsubscribe from printed products at any time.

Data processing is carried out based on overriding legitimate interests (Art. 13, para. 1 FADP and Art. 6, para. 1, sentence 1, point b) GDPR).

Data transfer to third parties

We do not transfer your personal data to third parties for purposes other than those stated here and in our cookie policy.

Your personal data is transmitted to service providers in the fields of personalized email marketing, remarketing, direct marketing, targeting, online payment services, address processing service providers, search engine operators, certification services, manufacturers, distributors, and logistics partners. In addition, they are transferred within the MTH Retail group to which OWIBA SA belongs.

The transmission takes place for the purpose of executing the contract or for carrying out pre-contractual measures (Art. 13, para. 1, let.a FADP and Art. 6, para. 1, sentence 1, point b) GDPR), with your consent in the case of personalized email marketing, remarketing, direct marketing, or customer reviews (Art. 13, para. 1 FADP or Art. 6, para. 1, point a) GDPR) or based on an overriding legitimate interest (Art. 13, para. 1 FADP and Art. 6, para. 1, sentence 1, point b) GDPR).

Furthermore, data is not transferred to third parties or categories of third parties not mentioned.
